Questions Texas trial lawyers ask.
What is a policy limit analysis in Texas?
A policy limit analysis is a data-driven, pre-litigation report of likely liability coverage, built from lawful sources and provided as an informational tool. Texas trial lawyers use it for case screening and demand strategy before filing.
Can I learn a defendant's policy limits before suit in Texas?
Texas has no general statute requiring a liability insurer to disclose its insured's limits before a lawsuit is filed. Actual limits typically come from the insured's consent or a voluntary disclosure. Once suit is filed, Texas Rule of Civil Procedure 194.2 includes indemnity and insuring agreements among the required initial disclosures. A policy limit analysis gives attorneys a researched view of coverage earlier, at the pre-litigation stage.
How do policy limits relate to a Stowers demand?
Under the Stowers doctrine, from G.A. Stowers Furniture Co. v. American Indemnity Co. (1929), a liability insurer that unreasonably rejects a reasonable settlement demand within policy limits may face exposure beyond those limits. Because a Stowers demand is framed around the limits, many Texas attorneys size up the case before drafting one. A policy limit analysis supports that pre-litigation strategy; it is not proof of coverage.
What are Texas minimum auto liability limits?
Texas requires minimum auto liability coverage of $30,000 per injured person and $60,000 per accident for bodily injury, and $25,000 for property damage, commonly written as 30/60/25. Minimums are a floor, not a measure of what any defendant actually carries.
Will a policy limit analysis include a policy number or declarations page?
No. Policy numbers, declarations pages, endorsements, and coverage as of a date of loss come from the insured, the carrier, or discovery. A policy limit analysis is a high-level assessment of coverage for pre-litigation strategy.
Is Coastal Research a TTLA partner?
